Demystifying Legal Reasoning defends the proposition that there are no special forms of reasoning peculiar to law. Legal decision makers engage in the same modes of reasoning that all actors use in deciding what to do: open-ended moral reasoning, empirical reasoning, and deduction from authoritative rules. This book addresses common law reasoning when prior judicial decisions determine the law, and interpretation of texts. In both areas, the popular view that legal decision makers practise special forms of reasoning is false.

We propose that the fundamental mechanism underlying resilience is the integration of novel or negative experiences into internal schemata. This process requires a switch from reactive to predictive control modes, from the brain's salience network to the default mode network. Reappraisal, among other mechanisms, is suggested to facilitate this process.

Humans are unconditionally confronted with social expectations and norms, up to a degree that they, or some of them, have a hard time recognizing what they actually want. This renders them susceptible for introjection, that is, to unwittingly or “unconsciously” mistake social expectations for self-chosen goals. Such introjections compromise an individual’s autonomy and mental health and have been shown to be more prevalent in individuals with rumination tendencies and low emotional self-awareness. In this brain imaging study, we draw on a (...) source memory task and found that introjections, as indicated by imposed tasks that are falsely recognized as self-chosen, involved the bilateral medial prefrontal cortex and the dorsal anterior cingulate cortex. Notably, reduced right MPFC activation within this condition correlated with trait scores of ruminations and reduced emotional self-awareness, but also introversion. Moreover, correct recognition of tasks as self-chosen involved the right MPFC. Accordingly, the right MPFC may play a role in supporting the maintenance of psychological autonomy and counteract introjection, which individuals with certain personality traits seem to be prone to. This research has significant implications for the study of mechanisms underlying autonomous motivation, goal and norm internalization, decision-making, persuasion, education, and clinical conditions such as depression and burnout. This essay provides an analysis of environmental racism and the environmental justice movement with a view to implications for Christian moral theory. Three topics are analyzed: the collective and systemic nature of injustice, the presentation of the ecocrisis, and environmental justice as social transformation. The outcome for Christian ethics turns on the boundaries of moral community—who is in, who is out, on whose terms—and on revisions in theories of justice.

When regimented in a certain natural way, the concepts of explanation and justification manifest a pattern of interrelations connected more or less systematically to their object. Besides its intrinsic interest, this pattern may give us some insight into the nature, source, and limits of the concept of argument.

Violence presents a paradox. There is evidence that violence is universal in all in human societies. However, in writing mostly from the standpoint of relatively peaceful social spaces, violence often appears exceptional, and a product of the breakdown of integrating social institutions and conventions. Norbert Elias persuasively identified growing thresholds of repugnance towards violence with the transition to modernity, although understanding the balance between formalization and informalization poses some critical questions about his thesis. The discussion begins with these as a (...) means of opening a broader discussion of theories of violence which are developed through a critical analysis of Girard’s and Gans’ theories. It is argued that these may offer a way of addressing the informalization problem in a context of mimetic consumption desires in a context of apparent but false equalization in contemporary societies. During the influx of neurological research into France from across Europe that took place rapidly in the late 19th century, the philosophy course in lycées was mobilized by education reformers as a means of promulgating the emergent brain sciences and simultaneously steering their cultural resonance. I contend that these linked prongs of philosophy’s public mission under the Third Republic reconciled contradictory pressures to advance the nation’s scientific prowess following its defeat in the Franco-Prussian war of 1870 without dropping France’s distinct (...) tradition of 19th-century spiritualism, which extended from Maine de Biran’s philosophical psychology to Victor Cousin’s official eclectic spiritualism. Between 1874 and 1902, the French Ministry of Public Instruction transformed philosophy into a national project designed to guide the reception of experimental psychology generally and neurology in particular. This article features original archival research on philosophy textbooks and students’ course notes that illuminate the cultural and intellectual impact of these sciences in the fin de siècle from inside the classroom. I argue that the scientific turn in the psychology section of the lycée philosophy course reflected and brought about a distinct philosophical movement that I call ‘scientific spiritualism’. While historians have analysed philosophy instruction as a mechanism used by the Third Republic to secularize students, this article sheds new light on lycée philosophy professors’ campaign to promote scientific spiritualism as a means to advance incipient brain research and pare its reductionist implications. In this paper today, I would like to offer a new analysis of causation and of causal claims. It is an unorthodox one, as you will see, but I suspect that in the not too distant future it will be seen as intuitively, perhaps even trivially, true. I hardly need defend the urgency of my project. Ever since Hume, philosophers have wondered whether there are causes. This is a desperate situation. With no causes, it's hard to see how brushing my (...) teeth is likely to prevent tooth decay. Indeed, it would not be unreasonable to read Hume as an advocate of rotten teeth, which might explain the sad state that many British mouths find themselves in today. The attentive listener will have noted that I said Hume's advocacy of rotten teeth might explain the abysmal state of British oral hygiene. Of course, if Hume is right about causation then nothing explains anything, and that explains why I have been tentative in my claim. The account I would like to propose is this. The claim ‘x causes y’ is to be understood in the following way: ‘x makes y happen’. That is, to say that x is the cause of y is just to say that x makes y happen. Or, to put it more succinctly, if x is the cause of y, then x makes y happen. This is no doubt a startling claim, and one in need of further clarification and defense. To begin, I should like to contrast my analysis with another that might, on its surface, appear similar. Suppose one were to claim that 'x is the cause of y' means that x brings y about. But ‘bringing about’ is hardly an informative verbal clause, and does little ampliative work. This way of putting it lacks the opaque transparency that we’ve come to expect of philosophical analyses of causation. Now this new account is not necessarily inconsistent with other, more traditional analyses, such as Lewis and Hausman's analyses of causation in terms of counterfactuals or Eells' probabilistic theory of causation. In the pursuit of a naturalized philosophy of mind, consciousness receives concentrated attention, in part because the phenomena of consciousness seem recalcitrant, difficult to explain in the terms of the natural sciences. But this is not a new phenomenon—efforts to provide a naturalized theory of consciousness originate in Ancient Greek philosophy. This chapter defines the project of naturalism in a way that allows for a common project to be traced through the history of Western Philosophy.
